A woman was accused of killing her husband, his body was never found and she was sentenced. Years after serving her jail term, she found out the man is living with another woman.
She went and shot the man several times and he died for real this time around and she was re-arrested for the same murder on the same person.
As a judge, will you look at the case as a fresh murder or will you look at it as a crime she already served the term?
Double jeopardy...but my thought is, two wrongs can't make a right.
ReplyDeleteIt's complicated but I think this manslaughter
ReplyDeleteIt cant be manslaughter because manslaughter is unintentional killing
DeleteThis is very complicated now,but there is something in law called double jeopardy, so one can't be tried for the same thing twice unless is under appeal persuasion.
ReplyDeleteGood morning
Remember she had served a jail term of a crime she didn't commit. Now that she has committed can she be jailed again?
DeleteSad but i think it should be reduced to manslaughter
ReplyDeleteBut she literally killed this time round. Manslaughter is applicable where the murder was not intentional.
DeleteI will compensate the lady!
ReplyDeleteHow do you compensate a lady who has already committed an offense?
DeleteHow can you stand trial for killing an already dead person??
ReplyDeleteShe served jail term when the man had not died but on completion of her jail term and realizing that the man was alive and living with another woman she decide to kill him
